1. Who we are

Relèvesanté (the "Service") is operated by Recrutement Relèvesanté Inc. ("we", "us", "our"), a company incorporated in Québec, Canada. By using the Service you are contracting with Recrutement Relèvesanté Inc.

2. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms & Conditions. If you do not agree, do not use the Service. You confirm you are of legal age and, if using the Service on behalf of a business, that you have authority to bind that business.

3. The Service

Relèvesanté is a bilingual (English / Canadian French) marketplace that connects healthcare businesses (pharmacies, dental clinics) with independent healthcare professionals for short-term shifts. We provide the software; we are not a party to the professional services performed between businesses and professionals.

4. Account & accuracy

You must provide accurate information (name, contact details, professional licence, business address) and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account.

5. Acceptable use

You must not misuse the Service. In particular, you agree not to:

  • use the Service for any unlawful, fraudulent, or deceptive purpose;
  • send spam, misleading job postings, or fake applications;
  • infringe intellectual property or privacy rights of others;
  • interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering, circumventing technical limits);
  • resell or redistribute the Service without our written consent.

6. Intellectual property

Recrutement Relèvesanté Inc. retains all rights, title and interest in the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

7. Subscriptions, payments & refunds

Business (owner) accounts are billed on a recurring subscription (currently CA$200 / month). Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, taxes, invoicing, currency conversion, cancellations, and refunds are governed by the Paddle Buyer Terms. Our own Refund Policy also applies.

8. Service level & warranties

The Service is provided "as is". We do not guarantee that it will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where such exclusion is prohibited by law.

10. Indemnity

You will indemnify and hold harmless Recrutement Relèvesanté Inc. against claims arising from your content, your use of the Service in breach of these Terms, or your violation of applicable law.

11. Suspension & termination

We may suspend or terminate your access if you: (a) materially breach these Terms, (b) fail to pay amounts due, (c) create a security or fraud risk, or (d) repeatedly or seriously violate our policies. On termination, your right to use the Service ends; you may request an export of your data within 30 days, after which we may delete it.

12. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be communicated in-app or by email. Continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Province of Québec and the applicable federal laws of Canada. The courts of the district of Montréal have exclusive jurisdiction, subject to any mandatory consumer-protection rights.
